For those of you in business you need to be aware that the small claims court limit has now gone up from £5000 to a huge £10,000 in one go. We at TM Law believe that £10,000 is a lot of money to small and medium businesses.
What this means for you is that if you have to go to court, and even if you succeed, you will not recover any legal fees only the court fees you paid.
At TM Law we are working on schemes to soften the blow of this so that you can still bring a claim for up to £10,000 and use a competent solicitor to do it.
One of the things we will do is do the job for a fixed price for example £2,000 plus vat and you paying the court fees.
Another way we could run it is to take a percentage of what we recover up to 50%. We may want a minimum guaranteed fee up front so that if we lose the claim we at least earn something!
We are always looking for ways to help you in bringing your claims which the court are trying to keep out of court by for example increasing the small claims limit to £10,000.
In our view £10,ooo is not a small sum of money and a dispute over that sum could be costly or you may decide not to persue it as a result of it being put into the small claims court.

If you are in dispute with an organisation or an individual and wish to recover specific sums of money you feel you should not have paid, then you can issue a claim at county court level against that individual or firm. If the claim is for less than £5000 (or £1,000 or less if the claim is for personal injury or housing disrepair) then the small claims system is set up for you to use cheaply, quickly and easily, without the involvement of lawyers or other legal professionals. For claims over £5000, you will be referred to the fast track or multi-track. Please note, this only applies to England and Wales.
